The Ministry of Enterprises and Made in Italy, formerly Ministry of Economic Development, is designated National Competent Authority (NCA3TG) for the implementation of Regulation (EU) 2017/821 of the European Parliament and of the Council of 17th May 2017 laying down supply chain due diligence obligations for Union importers of tin, tantalum and tungsten, their ores, and gold originating from conflict-affected and high-risk areas.
It is constituted pursuant to Article 2(1) of Legislative Decree No. 13th of 2nd February 2021 on ‘Implementation of the delegation of powers to the Government for the adaptation of national legislation to the provisions of Regulation (EU) 2017/821 of the European Parliament and of the Council of 17th May 2017 imposing obligations relating to the duty of care in the supply chain for Union importers of tin, tantalum and tungsten, their ores, and gold, originating in conflict or high-risk zones’ (Official Journal No. 39 of 16-02-2021).
The NCA3TG ensures the effective and uniform application of the Regulation by carrying out the tasks and exercising the functions provided for in Articles 3, 10, 11, 12, 13 and 16 thereof.
The management of the ANC3TG's activities is entrusted to Division IV - Policies for small and medium-sized enterprises, start-ups, the cooperative movement, and the social economy of the Directorate-General for Industrial Policy, Industrial Conversion and Crisis, Innovation, SMEs and Made in Italy.
The support body of the NCA3TG in carrying out its functions is the Activity Coordination Committee (Article 8 of Legislative Decree No. 13/2021).
It provides the Authority with technical input in matters falling within the competence of the participating Administrations. It is composed of a representative and an alternate designated by:
- Ministry of Enterprises and Made in Italy - The chairing Authority;
- Presidency of the Council of Ministers
- Ministry of Foreign Affairs and International Cooperation;
- Ministry of Economy and Finance;
- Ministry of Justice.
In particular, the Committee coordinates the activities carried out by each of the participating Administrations for the effective and uniform application of the Regulation and those relating to the drafting of the annual report that the Authority must submit to the European Commission by 30th June each year, expresses its opinion on the annual programme of ex-post checks prepared by the Authority, examines and expresses its opinion on any reasoned proposals for amendments, presented by ANC3TG, to the annual programme of ex-post checks formulates any observations and proposals regarding the performance of supplementary activities for the effective and uniform application of the regulation, to be submitted and evaluated by the Authority.
The Committee's Secretariat functions are carried out by the staff working in Division IV - Policies for small and medium-sized enterprises, start-ups, the cooperative movement, and the social economy of the Directorate-General for Industrial Policy, Industrial Conversion and Crisis, Innovation, SMEs, and Made in Italy. The Secretariat is responsible, among other things, for assisting the President in convening, preparing and organising meetings, providing support for the logistical and administrative management of the Committee and its meetings, participating in the preparation of documentation and the drafting of technical briefs, and drafting meeting minutes.
