The Authority (ANC3TG) is responsible for ensuring the effective and uniform application of Regulation (EU) 2017/821, in particular, by performing the tasks and exercising the functions provided for in Articles 3, 10, 11, 12, 13 and 16 thereof.
The Authority participates in the work of the Group of Experts at the European Commission and the Committee referred to in Article 15 of the Regulation and in international organisations, in particular, the OECD.
It promotes the dissemination of the contents of the Regulation through communication, information, guidance and awareness-raising initiatives and tools on the adoption of due diligence mechanisms by importers and throughout the supply chain, in particular in favour of SMEs, including EU support instruments and measures for SMEs.
It also carries out awareness-raising activities among civil society and any other interested parties to spread knowledge of the aims and objectives of the regulation. Moreover, it periodically carries out monitoring and evaluation activities of the impact of the regulation on Italian SMEs, through specific surveys, also in cooperation with the trade associations representing them.
In order to ensure the correct application of the due diligence obligations, the Authority carries out ex-post controls on EU importers falling within the scope of the Regulation according to the modalities set out in the Directorial Decree of 17 March 2022, on ‘Operational modalities and discipline for the execution of ex-post checks referred to in Articles 3, 4, 5, 6, 7, 11, 12 and 13 of Regulation (EU) 2017/821 and Articles 5 to 7 of Legislative Decree No. 13/2021’ (Annex A and Annex B)
It verifies the manner in which the aforementioned obligations are implemented, the supporting documentation and prescribes any corrective measures and specific fulfilments to be applied in the event of breaches of the regulation. The Authority further carries out investigations and imposes administrative sanctions in the event of non-compliance with the requests and non-compliance with the deadlines indicated therein.
To this end, the Authority is equipping itself with a web platform as a tool for promoting and supporting importers and businesses in the supply chain, to be used also as a tool with access reserved for importers to digitally manage all phases of the technical-administrative process of ex-post checks, also thanks to native interoperability with the Business Register. As part of the platform's functionalities, the different roles and permissions within the application are defined: importer, auditor (dedicated and appointed personnel by the Authority with access to technical files and on which they carry out ex post controls), Authority/Staff-Secretariat.
