The Authority carries out investigations into the application of the duty of care and is authorised to impose administrative sanctions, which are effective, dissuasive and proportionate to the seriousness of the specific breach, in the event of non-compliance with its requirements and non-compliance with the time limits it has set (Article 7, Legislative Decree No. 13/2021).
- The importer who:
within the deadlines indicated by the Authority, does not comply with the Authority's requests or does not allow, on the dates indicated in the request, inspections and assessments, incurs an administrative fine of a sum of between EUR 2,000 and EUR 20,000; - in the manner and within the deadlines indicated in the plan approved by the Authority, fails to adopt the corrective measures prescribed by the Authority shall be punished with a pecuniary administrative sanction of the payment of a sum from EUR 5,000 to EUR 20,000.
For anything not provided for in Legislative Decree No. 13/2021, the provisions of Law No. 689 of 24th November 1981 shall apply.
