Directorial Decree 17 March 2022 - Operational procedures and rules for carrying out the ex-post controls referred to in Articles 3, 4, 5, 6, 7, 11, 12 and 13 of Regulation (EU) 2017/821 and Articles 5 to 7 of Legislative Decree No 13/2021 (Annex A (pdf) and Annex B (pdf))
The Ministry of Enterprise and Made in Italy, formerly the Ministry of Economic Development, Directorate General for Industrial Policy, Innovation and Small and Medium Enterprises (now Directorate General for Industrial Policy, Industrial Conversion and Crisis, Innovation, SMEs and Made in Italy) has issued the directorial decree defining the operational modalities for the implementation of ex-post checks on Union importers that fall within the scope of Regulation (EU) 2017/821 and are carried out by the National Competent Authority.
In particular, the directorial decree outlines the scope of application of these controls, the subjects entrusted with their implementation, the investigative procedure, the subject of the checks and the way they are carried out through the backend section (soon to be activated) of the Authority's web platform, the different outcomes of the control procedure and the possible corrective actions and administrative sanctions to be notified to the importer in the event of infringements and non-compliance.
The directorial decree entered into force on 22 March 2022, the date of its publication on the web platform of the National Competent Authority.
